1. Acceptance of these terms
By accessing or using Marketing Department HQ (“MDHQ,” “we,” “us”) websites, tools, or services, you agree to these Terms of Use. If you are using MDHQ on behalf of a business, you represent that you have authority to bind that business. If you do not agree, do not use the site or services.
2. Service description
MDHQ provides outsourced local marketing support and related digital tools for businesses.
That may include campaign planning, messaging, local market research support, ongoing communication
systems, and self-serve tools such as the City Campaign Generator at /tool.
Features, availability, and deliverables may change over time. Marketing results vary; we do not guarantee specific lead volume, rankings, revenue, or conversion outcomes.
3. Accounts & OAuth sign-in
Some features require sign-in (for example, Google Sign-In on /tool) so we can verify
your email and deliver results. You are responsible for activity under your account and for keeping
access to your sign-in method secure.
You agree to provide accurate information when requested (such as a business name or location selections) and not to impersonate another person or business.
See our Privacy Policy for how we handle personal data from Sign-In and the tool.
4. Acceptable use
You agree not to:
- Use the site or tools for unlawful, deceptive, harassing, or abusive purposes
- Attempt to probe, disrupt, overload, or reverse engineer our systems except as allowed by law
- Scrape, harvest, or bulk-export content or data in a way that harms service performance or violates others’ rights
- Misuse generated campaign content to impersonate others or send spam
- Circumvent rate limits, authentication, or access controls
We may suspend or terminate access if we reasonably believe these terms were violated.
5. Intellectual property
The MDHQ site design, branding, documentation, and software are owned by MDHQ or its licensors. You may use campaign ideas and copy generated for your business in your own marketing, subject to these terms and any separate service agreement.
You retain rights to materials you provide to us. You grant MDHQ a limited license to use those materials as needed to operate the services you request.
6. Disclaimers
The site, tools, and sample campaigns are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, MDHQ disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
AI-assisted and template-based outputs are starting points. You are responsible for reviewing content before publishing and for complying with advertising, privacy, and industry rules that apply to you.
7. Limitation of liability
To the fullest extent permitted by law, MDHQ and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, arising from your use of the site or services.
Our total liability for any claim relating to the site or free tools is limited to the greater of (a) the amount you paid MDHQ for the specific paid service giving rise to the claim in the three months before the claim, or (b) fifty U.S. dollars (USD $50) for unpaid / tool-only use.
8. Governing law
These terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law rules, unless a different jurisdiction is required by applicable law or named in a separate written agreement with you.
9. Changes
We may update these Terms of Use from time to time. The effective date at the top of this page will change when we do. Continued use after an update means you accept the revised terms.
